By accessing, browsing, or making a purchase on the Site, you agree to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Return & Refund Policy (collectively, the “Policies”).   • Placing an order on the Site constitutes a formal offer to purchase the selected products in accordance with these Terms and the listed pricing at the time of order placement.
  • We may accept or reject your order at our sole discretion, including (but not limited to) cases of product unavailability, pricing errors, suspected fraudulent activity, incomplete/incorrect order information, or payment processing issues.
  • A binding contract between you and us is formed only when we ship your order and send a shipping confirmation email containing a valid tracking number. Prior to shipment, we reserve the right to cancel any unprocessed/unshipped order and issue a full refund with no further liability.
  • We attempt to maintain accurate product availability on the Site, but occasional stock discrepancies may occur (especially for handcrafted LAETITIA ROUGET pieces). If a product you ordered is out of stock, we will notify you promptly via email and offer a full refund or a pre-order option (if available) at your sole discretion.
 

4. Pricing & Payment

 
  • All product prices listed on the Site are in United States Dollars (USD) and include applicable sales tax (per Tennessee state law) where required. Shipping fees and other applicable charges are added at checkout and are separate from the product price.
  • Prices are subject to change without prior notice. We are not obligated to honor any typographical, technical, or system errors that result in incorrect pricing on the Site. If a pricing error is identified, we will notify you and offer to cancel the order or process it at the correct price.
  • You agree to pay the total amount displayed at checkout (product price + tax + shipping + fees) for your order.
  • We use secure, third-party payment processors (compliant with PCI DSS standards) to process all payments. We do not store your full credit/debit card details on our servers—all payment data is encrypted and processed by our trusted payment partners.

However, color variations may occur due to screen resolution, lighting, and the handcrafting process; minor variations in handcrafted ceramic pieces (LAETITIA ROUGET, JARS) are normal and do not constitute a defect—these variations are part of the unique artistic character of each piece.
  • We reserve the right to modify, discontinue, or update any product (including design, materials, and pricing) at any time, without prior notice—especially for limited-edition handcrafted pieces.
  • Product weights and dimensions are approximate and provided for reference only—handcrafted ceramic items may have slight size variations that are inherent to their creation.
 

6. Shipping & Delivery

 
All shipping and delivery terms are governed by our separate Shipping Policy, which is fully incorporated into these Terms. Key provisions include order processing times, specialized packaging for fragile ceramic pieces, shipping methods, delivery estimates, and risk of loss transfer (title and risk of loss pass to you upon delivery of the product to the shipping carrier).
 

7. Returns, Refunds & Exchanges

 
All returns, refunds, and exchange requests are governed by our separate Return & Refund Policy, which is fully incorporated into these Terms. This Policy outlines strict eligibility requirements for our fragile handcrafted ceramic pieces, return procedures, and refund processing for all purchases—no returns are accepted without prior written authorization from our customer service team.
 

8. Intellectual Property

 
  • All content on the Site—including text, logos, product images, graphics, design elements, trademarks, and layout—is the exclusive intellectual property of Tonya Maples LLC or its licensed brand partners (LAETITIA ROUGET, JARS) and is protected by U.S. copyright, trademark, and other intellectual property laws.

  • We shall not be liable for any delays, losses, or damages caused by events beyond our reasonable control (“Force Majeure”), including (but not limited to) natural disasters, carrier delays, labor strikes, power outages, government regulations, internet service provider failures, or supply chain disruptions (including delays for handcrafted ceramic pieces from our makers).
  • This limitation of liability applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) under which the claim is brought, and survives the termination of these Terms or your use of the Site.

You agree to indemnify, defend, and hold harmless Tonya Maples LLC, its owners, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, expenses, and liabilities (including reasonable attorney’s fees) arising out of or related to:

15. Dispute Resolution

 
Any dispute, claim, or controversy arising out of or related to these Terms shall first be submitted to good-faith informal negotiation between you and us. If the dispute is not resolved within 30 days of written notice, the dispute shall be resolved exclusively in the state or federal courts located in Weakley County, Tennessee, and you consent to the exclusive personal jurisdiction and venue of such courts. You waive any right to a jury trial in any such dispute.
 

16. Severability

 
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, consistent with the original intent of the parties.

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire and exclusive agreement between you and Tonya Maples LLC regarding your use of the Site and purchase of products. These Terms supersede all prior oral or written agreements, understandings, and representations between the parties.
